In honor of the Day of Liberation of Jerusalem and the Land of Israel, next week  Friday the 19^th of Iyar, May 24^th, at 9:00 am, at the Cherna Moskowitz Zionist Library in Oz veGaon,

we will please G-d host historian and fighter Dr. Haim Shalem, who fought at Ammunition Hill.

Dr Haim Shalem will speak on the battle, on the friends and on devotion to Jerusalem. The lecture will be accompanied by a film.

תנועת הריבונות על תוכנית טראמפ: שלב לריבונות - כן, בסיס לישות פלשתינית - לא

 

בתנועת הריבונות מתייחסים בדאגה לפרטיה של 'עסקת המאה' כפי שהוצגו הערב (ראשון) בחדשות 12. "החלת החוק הישראלי האזרחי על הישובים ביהודה ושומרון אינה אלא ניסיון מאולץ ומסוכן לפשרה שתאפשר הקמתה של ישות פלשתינית על שאר השטח", אומרים בתנועה.

 

ראשי התנועה, יהודית קצבור ונדיה מטר, מזכירות כי באחרונה הזהירה התנועה בדיוק מהשלכותיו של תרחיש שכזה. "על ארץ ישראל לא עושים עסקאות או פשרות. ארץ ישראל כולה שלנו ועלינו להחיל עליה את ריבונותה המלאה של מדינת ישראל", אומרות השתיים.

 

לדבריהן "מעבר לזכות ההיסטורית שאינה ניתנת לפשרה, הקמת ישות מדינית פלשתינית על מרחבי יהודה ושומרון תהווה סכנה חמורה פי כמה מזו האורבת לנו מרצועת עזה. התכנית תהווה הוכחה נוספת עבור האויב הערבי לכך שלחץ טרוריסטי לצד לחץ בינלאומי מכריעים את ישראל הנסוגה שוב ושוב מאדמתה ומפנה עוד ועוד שטח לטובת כנופיות טרור שנשבעו להקים מדינה על חורבותיה של ישראל".

 

"יכולות ההסברה הערביות מוכחות, אך אין בהן כדי להפוך את הצד הערבי לצד הצודק. ארץ ישראל כולה שייכת לעם ישראל ולו לבדו", דברי קצובר ומטר המדגישות כי "את תכנית טראמפ ניתן יהיה לקבל אך ורק אם היא תוגדר כבר כעת כשלב ראשון בדרך להחלת ריבונות ישראלית מלאה על כלל שטחי יהודה ושומרון".

The Sovereignty Movement on Trump's proposal: as a 1st phase of sovereignty– yes; as a basis for a Palestinian entity – no

The Sovereignty Movement is concerned about the details of the Deal of the Century, as they were presented this evening (Sunday) in the Channel 12 News. "The application of Israeli civil law over the Jewish communities in Judea and Samaria is simply a bumbling and dangerous attempt at compromise that will allow for the establishment of a Palestinian entity in the rest of the territory", spokespeople for the movement say.

The co-chairwomen of the movement, Yehudit Katsover and Nadia Matar, remind us that the movement has recently issued a warning precisely on the ramifications of such a scenario. "We do not make deals or compromises on the Land of Israel. The Land of Israel is entirely ours and we must apply the State of Israel's full sovereignty over it", say the two women.

According to them, "beyond the historic right, which is not subject to compromise, the establishment of a Palestinian entity in parts of Judea and Samaria would present a danger several times more severe than that posed by the Gaza Strip. The plan would serve as further proof to the Arab enemy that terror threats along with international pressure can force Israel again and again to withdraw from her land and transfer more and more territory to terror groups that have vowed to establish a state upon the ruins of Israel".

"The capability of Arab public relations is proven, but this cannot turn the Arab side into the just side. The Land of Israel belongs entirely to the Jewish People and only to the Jewish People, say Katsover and Matar, who emphasize that "the Trump plan will be acceptable if, and only if, it is defined already now, as the first step on the way to the application of full Israeli sovereignty over the entire territory of Judea and Samaria".

פרשני השמאל, דובריו ושאר תומכי הנסיגות וההתקפלויות רואים את הקולות, את קולות נפץ הרקטות, שומעים את המראות, את מראות ההלוויות והתושבים החרדים וחוזרים אל עמדותיהם הקדומות כאילו דבר אינו קורה סביבנו. 'זו לא ההתנתקות' הם אומרים, מכריזים 'גם לפני ההתנתקות היו טילים' ומציגים נתונים ומספרים. הגיעה העת להשיב לטענות הללו, לשים קץ למידע המגמתי שמרעיפים עלינו.

הבה נרענן את זיכרוננו:

אכן, לא בעקירה מגוש קטיף החלה מתקפת הטילים והרקטות על העורף הישראלי. ירי שכזה היה עוד קודם לכן, אבל בחינת העובדות מתחילה עוד הרבה קודם לכן על מנת להגיע לתובנות אמת ולמסקנות לעתיד:

כל עוד שלט צה"ל בכל רצועת עזה לא היו טילים. אמנם בשנת 1987 הייתה האינתיפאדה הראשונה, אבל הנשק שאותו הפנו הערבים לעברינו היו אבנים ולעתים גם בקבוקי תבערה. לא מעבר לזה. צה"ל פיקח על הכבישים ונכח בתוך הערים. השליטה המודיעינית של כוחות הביטחון הייתה מלאה ופיגועים רבים נמנעו עוד בשלב התכנון. גם ניסיונות הברחת נשק סוכלו. הסיבה הייתה פשוטה: צה"ל נכח שם.

ואז במקום לחסל את האינתיפאדה אחת ולתמיד הגו קברניטי הנסיגות והוויתורים עם רעיון התיגמול לתוקפן וחתמו על הסכמי אוסלו. במאי 1994 נחתם הסכם עזה-יריחו ובעטיו יצא צה"ל מרוב השטח ברצועת עזה, מהערים ומהכפרים לבד מגוש קטיף, נצרים, כפר דרום, אלי סיני ודוגית והשטח הופקר לשליטת הרשות הפלשתינית.

זה התחיל עם פצצות מרגמה מיושנות, פצמ"רים, זוכרים? הפצמ"ר הראשון שוגר לעבר נצרים בינואר 2001, סיממנו את עצמנו עם המשפט "טוב. זה סתם פצמ"ר", אבל מאז הם רק הלכו והשתכללו ואנחנו כבלנו את ידינו עם השאלה "מה, נכבוש את עזה?" והפכנו את עצמנו לחסרי אונים. מעט מהטעויות ההן תוקנו ביהודה ושומרון במבצע 'חומת מגן', כאשר נוכחותו של צה"ל שבה לכל הערים והכפרים. בעזה, לעומת זאת, לא היה מבצע שכזה. כך התקבעה מציאות שבה ביו"ש אין רקטות ובעזה יש ויש.

מכאן ואילך ניתן לערבים חופש פעולה ושקט לתכנן את ההסלמה, את עליית המדרגה, את שיפור הרקטות והטילים, את ההתחמשות וההתארגנות הצבאית. איש לא הפריע להם. הרקטות הראשונות היו פרימיטיביות, פגיעתם הייתה הרסנית הרבה פחות וכך גם דיוק הפגיעה שלהן, אבל המחבלים השתכללו צעד אחר צעד והרקטות החלו להגיע ליישובי גוש קטיף ובהמשך לעבר שדרות והלאה.

גם האיתותים הכואבים ההם לא העירו את ההנהגה בישראל ולא הביאו אותה לשוב מדרכה המדינית. ההמשך היה תכנית ההתנתקות והעקירה מיישובי גוש קטיף וצפון השומרון מתוך תקוות הזויות וחסרות בסיס שהאויב יהפוך את הרצועה לסינגפור של המזרח התיכון. נסיגת צה"ל מהרצועה הרחיבה את חופש הפעולה שניתן לערביי עזה. חמאס השתלט בכוחנותו ובאלימותו על רצועת עזה, סילק את מנהיגות הרש"פ והאיץ את פיתוח הרקטות והטילים עד למציאות הנוכחית בה טווח פגיעתן מגיע עד תל אביב ובנותיה.

בצל כל אלה התעצמו יכולותיו של חמאס גם מתחת לאדמה ופתח בחפיר מנהרות טרור לאורך קילומטרים רבים במגמה להוציא לפועל פיגועי חטיפה והשתלטות אסטרטגיים. בהיעדר הנוכחות הישראלית ברצועה יכול היה חמאס להכין ולשכלל את הפתעת הטרור התת קרקעית שלו.

זו המציאות וזו ההיסטוריה. כל הנתלים בטפטוף הרקטות הפרימיטיביות שטרם ההתנתקות כהוכחה שלא היא זו שהביאה עלינו את סבבי האסון שאנו בעיצומם, עושים שקר בנפשם ומתעתעים בכולנו. לו לא הייתה ממשלת ישראל חותמת על הסכמי אוסלו ומפקירים את רצועת עזה למחבלים ולו לא היינו מוסיפים על החתימה האסונית ההיא את ההתנתקות המוחלטת מהרצועה, שכזכור גם היא חלק מארץ ישראל, לו היינו מחילים כבר אז את ריבונותנו המלאה על הרצועה לא היינו מגיעים למציאות הקשה של ימינו אלה.

כעת, ערב פרסום תכנית טראמפ עלינו לזכור את העובדות לאשורן ולהפנים כי רק שליטה ישראלית על השטח כולו היא שמביאה לשקט ביטחוני. הפקרת השטח לממשל עצמי ערבי תביא רקטות נוספות, הרסניות הרבה יותר, מדויקות הרבה יותר, והפעם מהרי השומרון אל גוש דן, ירושלים ועוד.

The Rockets from Gaza began in Oslo

Leftist commentators, its spokesmen and other supporters of withdrawal and concessions hear the sounds of rockets exploding; they see the sights, the spectacle of funerals and frightened residents but they  resume their biased positions as if nothing is happening around us.  "It's not because of the Disengagement", they say, declaring that "even before the Disengagement there were missiles" presenting data and numbers. The time has come to answer these claims, to put an end to the tendentious information that they serve up to us.

Let us refresh our memories:

Indeed, the attacks of missiles and rockets on the Israeli home front did not begin with the uprooting of Gush Katif. There were such attacks before then, but an examination of the facts from a much earlier time will allow us to come to a true understanding and draw conclusions for the future:

As long as the IDF controlled the entire Gaza Strip there were no missiles. Indeed, in 1987 there was the first Intifada, but the weapons that the Arabs used on us then were stones and sometimes even Molotov cocktails. Nothing more than that. The IDF monitored the roads and had a presence in the cities. The security forces had comprehensive intelligence and many terror attacks were prevented while even in their planning phase. Attempts to smuggle weapons were thwarted. The reason for this is simple: the IDF was there.

And then, instead of putting down the intifada once and for all, some leaders dreamed up withdrawals and concessions with the idea of rewarding the attacker and signed the Oslo Accords. The Gaza-Jericho accord was signed in May 1994, and the IDF left most parts of the Gaza Strip; they withdrew from the cities and the villages except for Gush Katif, Netzarim, Kfar Darom, Eli Sinai and Dugit, and the area was abandoned to the control of the Palestinian Authority.

It began with aging mortars , remember? "Patzmarim" in Hebrew.  When the first mortar was launched at Netzarim in January 2001, we deluded ourselves with the sentence "Well – it's just a mortar" but since then, they have only become more sophisticated and we have tied our own hands with the question, "What – are we going to reconquer Gaza?" And we made ourselves powerless. Some of these problems were corrected in Judea and Samaria during Operation Protective Wall, when the IDF presence returned to all of the cities and the villages. In Gaza, on the other hand, there was no such operation. This is the reason that there are no rockets from Judea and Samaria, but from Gaza there are so many.

From then on, the Arabs had the freedom of action and the calm to plan escalation, raising the level, improving their rockets and missiles, arming themselves and organizing their military. No one disturbed them. The first rockets were primitive; they were much less destructive and less accurate, but step by step the terrorists improved and the rockets began to reach the communities of Gush Katif and later to Sderot and even further.

Even these painful signals did not arouse the Israeli leadership and did not cause it to change its policy. Then came the Disengagement plan and the uprooting of the communities of Gush Katif and northern Samaria with the delusional and baseless hope that the enemy would turn the Strip into a Singapore of the Middle East. The withdrawal of the IDF from the Strip gave the Arabs of Gaza even more freedom of action. Hamas brutally and violently took over the leadership of the Gaza Strip from the PA and expedited the development of rockets and missiles to the present situation in which they can reach Tel Aviv and its suburbs.

Along with all of this, Hamas' capabilities have grown underground and it began digging terror tunnels many kilometers in length with the aim of carrying out abductions and strategic conquests. In the absence of an Israeli presence in the Strip Hamas  caught us off guard and prepared its underground terror.

This is the reality and this is history. Anyone who takes the primitive drizzle of rockets before the Disengagement as proof that it was not the Disengagement that caused the present rounds of disaster we are experiencing, are lying in their souls and deceiving all of us. If the government of Israel had not signed the Oslo Accords and abandoned the Gaza Strip to the terrorists, and if we had not added to this disastrous agreement, a total disengagement from the Gaza Strip, which, as we know, is also part of the Land of Israel - if we had then already applied our full sovereignty over Gaza, we would not have come to the difficult situation in which we are now.

Now, shortly before Trump's plan is publicized, we must remember the facts and acknowledge them and internalize the fact that peace and security will only be brought about by Israeli control of the entire territory. Abandoning any territory to Arab rule will bring about more and much more destructive rockets, this time from the hills of Samaria to Gush Dan, Jerusalem and more.

פסח תשע"ט- מכתב לידידינו

 

חברינו היקרים

 

ב"ה אנו אחרי הבחירות. הימין ניצח, אך יתכן וכוחו של מחנה הימין נחלש עם הותרתם של השרים שקד ובנט וחברת הכנסת שולי מועלם מחוץ לכנסת הבאה. לא יהיה בכוחה של העובדה הזו לבלום את ההתקדמות ההיסטורית של מדינת ישראל להחלת ריבונותה על יהודה ושומרון. כך גם לא תיעצר הפעילות שלנו לקידום החזון עד להשלמתו המעשית. הדבר יצריך כעת עבודה קשה ומאומצת יותר, אך הדבר לא ירפה את ידינו.

 

לפי שעה ניתן לציין מספר נקודות ציון המהוות עדות להתקדמות המשמעותית בסוגיית הריבונות:

1)   החלטת מרכז הליכוד מיום ה-31/12/17 להחלת הריבונות על מרחבי ההתיישבות, החלטה שהתקבלה בזכות עבודתם הקשה והמאומצת של חברינו שבח שטרן, נתן אנגלסמן וישי מרלינג.

2)   הכרת ארה"ב  בריבונות ישראל על רמת הגולן.

3)   התחייבותו הפומבית של ראש הממשלה להחלת הריבונות לא רק על גושי ההתיישבות, אלא גם על הישובים המבודדים

4)   הדיווחים מארה"ב ולפיהם לא תכלול 'עסקת המאה' של דונלד טראמפ מדינה פלשתינית אלא אוטונומיה (כך לפי הוושינגטון פוסט). משמעות הדברים היא הפנמה של הנשיא האמריקאי את גודל הסכנה הטמונה ברעיון הקמתה של מדינה ערבית בין הים לירדן.

 

כעת עלינו לבחון בזהירות את הדברים: אמנם תכנית טראמפ לא התפרסמה רשמית, אבל עלינו לבחון מספר שאלות מרכזיות כשהמובילות והחשובות שבהן הן:

א.    האם האוטונומיה הערבית שעליה מדבר נשיא ארה"ב תהיה תחת ריבונות ישראל?

ב.    האם החלת ריבונות על הישובים עלולה להוביל לבלימת התפתחותם? כלומר מה יהיה גורל השטחים שבין הישובים? האם ניתן יהיה לבנות ישובים נוספים באזורים אלה או שהגדרתם החוקית תמנע זאת?

 

עלינו לזכור שהחתירה לפתרון הבעיה הדמוגרפית אינה הצדקה לוותר על מילימטר מארץ ישראל, שכן אם חלילה ייפרץ העיקרון לפיו ארץ ישראל כולה שלנו, עלול לקרוס המגדל האידיאולוגי כולו.

 

משום כך עלינו לשוב לאמיתות חיינו:

את ארץ ישראל קיבלנו מהקב"ה על מנת להקים בה חברת מופת, לנהל את הארץ על פי אמות מוסר חברתיים, כלכליים, רוחניים, אלוקיים, לא באידיאה אלא בפועל. לא נוכל להימלט משליחותנו.

 

מאז יצאנו ממצרים, מאז הפכנו לעם, אנו חלק מהשליחות האדירה הזאת, שליחות שהתגברה והתעצמה עם שובנו לארץ מהגלות. בעוד בתפוצות הגלות הדגשנו את עבודת ה' הפרטית והאישית, הרי שכיום עבודת ה' עלתה לקומת העשייה הלאומית של כולנו.

עלינו לפעול למען עתידנו הלאומי ואף לחזור להגדה הארץ ישראלית. לדבוק ב-6 לשונות הגאולה ולא רק בארבע הידועות. בעוד ארבע הלשונות המוכרות המבוססות על בשורת הגאולה שמשה הביא לבני ישראל במצרים הן "והוצאתי, והצלתי, וגאלתי ולקחתי" (שמות ו' ו-ז) אבל השיא טמון בפסוק שאחריו (שמות ו',ח'): "והבאתי אתכם אל הארץ אשר נשאתי את ידי לתת אותה לאברהם ליצחק וליעקב ונתתי אותה לכם למורשה אני ה'". אלו שש לשונות הגאולה.

נתעכב מעט על הלשון השישית: "ונתתי אותה לכם מורשה" – לשון זו מחזירה אותנו לפסוק בספר במדבר ל"ג "והורשתם את הארץ וישבתם בה", שם מגדיר הרמב"ן בהשגותיו לספר המצוות של הרמב"ם את חובותינו כלפי ארץ ישראל העולות מפסוק זה: "שנצטווינו לרשת הארץ אשר נתן ה' לאבותינו לאברהם ליצחק וליעקב ולא נעזבה ביד זולתנו מן האומות או לשממה".

לאחר שהרמב"ן מנסח את המצווה באופן חיובי – "נצטווינו לרשת את הארץ"- הוא מוסיף, מחזק ומדגיש אותה גם בדרך השלילה "ולא נעזבה ביד זולתנו מן האומות". כלומר נאסר עלינו להותיר את הארץ תחת שלטונה של אומה אחרת מלבדנו. המשמעות היא שעלינו מוטלת החובה והזכות להחיל שלטוננו וריבונותנו על הארץ. (הרחיבה על כך הרבנית עידית איצקוביץ במאמרה 'החלת ריבונות - חובה מן התורה'. 'ריבונות' גיליון 7)

 

אמנם לצערנו שלטוננו על ארץ ישראל עדיין אינו שלם, אך עלינו להכיר תודה ולהודות על שאנו מתקרבים בצעדי ענק ללשון הגאולה השישית "ונתתי אותה לכם למורשה". כל זאת בזכות פועלכם המתמיד והנחוש בע"ה.

Pessach 2019- A letter to our friends

To our dear friends,

Thank G-d the elections are behind us. The Right won, but it seems that the rightwing camp has been weakened, since Ministers Shaked and Bennett and MK Shuli Mualem are left without a place in the next Knesset. This fact will not be enough to stop the State of Israel's historic progression in the application of its sovereignty in Judea and Samaria. Nor will our efforts toward the completion of this vision in practicality be halted. We will have to work harder, but we will not weaken in our efforts.

At this time, we can point a number of milestones which are evidence of significant progress regarding sovereignty:

1.       The Likud Central Committee's resolution on Dec. 31, 2017 to apply sovereignty over the  settlement enterprise, which was passed thanks to the hard and skillful work of  our friends Shevah Stern, Natan Englesman and Yishai Merling.

2.       The U.S. recognition of Israeli sovereignty over the Golan Heights.

3.       The prime minister's public commitment to apply sovereignty not only over the blocs of settlement but also over the isolated communities

4.       The reports from the U.S. that Donald Trump's "Deal of the Century" will not include a Palestinian state, but autonomy (according to the Washington Post). This means that the American president has internalized the great danger inherent in the idea of establishing an Arab state between the sea and the Jordan River.

 

Now we must weigh these things carefully: Although Trump's plan has not yet been officially published, we must examine a number of key questions, the main and most important of which are:

1.       Will the Arab autonomy of which the U.S. president speaks be under Israeli sovereignty?

2.       Might the application of sovereignty over the communities in Judea and Samaria cause them to cease developing? In other words, what will be the fate of the areas between the communities? Will it be possible to build more communities in these areas or will their legal definition prevent this?

We must remember that striving to solve the demographic problem is not a justification for surrendering one millimeter of the Land of Israel, because if, G-d forbid, the principle that the Land of Israel is entirely ours is breached, it could cause the collapse of the entire ideological structure.

Therefore, we must return to our truth:

We received the Land of Israel from the Almighty, in order to establish in it an exemplary society, to conduct ourselves in the Land according to societal, economic, spiritual and divine ethics, not in theory, but in practice. We cannot escape our mission.

Since leaving Egypt, since we became a People, we have been part of this great mission, the mission that has taken on more dimensions and more intensity with our return to the Land from exile. While in the diaspora we emphasized the worship of the Almighty in personal ways, today, the worship of the Almighty has risen to the practical, national level, relevant to all of us.

We must act for our national future and return to the Passover Haggadah of the Land of Israel. To cling to the 6 passages of redemption and not only to the four familiar ones. While the four familiar passages are based on the message of redemption that Moses brought to the Children of Israel in Egypt are "I will bring you out, I will deliver you, I will redeem you and I will take you to Me as a People" (Exodus 6:6-7), the high point lies in the passage after this (Exodus 6:8): " And I will bring you in unto the land, concerning which I lifted up My hand to give it to Abraham, to Isaac, and to Jacob; and I will give it you for a heritage. I am the Lord". These are the six passages of redemption.

Let us pause for a moment on the sixth passage: "And I will give it to you for an inheritance" – this passage points us back to a verse in Numbers 33 "And you shall inherit the Land and settle in it", where Nachmanides, in his response to Maimonides' Book of Mitzvot, defines our obligations to the Land of Israel as derived from this verse: "We are commanded to inherit the Land that the Almighty has bestowed upon our forefathers, to Abraham, to Isaac and to Jacob and we shall not abandon it to the hands of the nations or to wilderness".

After Maimonides formulates the commandment in positive terms – "we are commanded to inherit the Land" – he adds emphasis and strengthens this by wording it in a negative way as well "and we shall not abandon it to the nations". This means that we are forbidden to leave the Land under the control of a nation other than our own. The significance of this is that we are obligated and privileged to apply our rule and sovereignty over the Land. (Rabbanit Idit Itzkovitz expanded upon this in her article "The Application of Sovereignty – an Obligation from the Torah". The Sovereignty Journal, issue no. 7).

Indeed, unfortunately our rule over the Land of Israel still remains incomplete, but we must be grateful and appreciative that we are coming closer, by giant steps, to the sixth passage of redemption "And I will give it to you for an inheritance".

Today is a fateful day for the Land of Israel.

Today we will perform the proper and uncomplicated action- we will go and vote.

It is easier than having to go to demonstrations.

 We will all fulfill our own obligation to vote and then we will go and assist those who need assistance to go and vote.

We must be active, take initiative, make sure that our families, neighbors and friends have all come out to vote too. 

Each and every vote counts. This is our obligation today; to work hard in order to get everyone we know out to vote.

We will fulfill this joyfully and with a prayer that the rightwing camp will prevail. Vote properly!

בעקבות טענות להפרת זכויות יוצרים ולשימוש פוגעני בקטעי וידאו של תנועת הריבונות הוסר סרטון של 'מפקדים לביטחון ישראל'.

 

 

תנועת 'מפקדים לביטחון ישראל', המנהלת קמפיין חוצות אגרסיבי נגד חזון הריבונות, הורידה מהרשת סרטון שבו השתמשה בחומרי וידאו של תנועת הריבונות. כך הודיע בא כוחה של 'מפקדים לביטחון ישראל' במענה לטענת תנועת הריבונות ולפיה השימוש בסרטון נעשה תוך הפרת זכויות יוצרים וכאשר מטרתה של התנועה היה לנגח את תנועת הריבונות ולהיאבק במטרותיה.

 

את הסרטון המדובר הפיצה תנועת 'מפקדים לביטחון ישראל' כחלק מקמפיין הרואה בחזון הריבונות הישראלית על יהודה ושומרון ראשיתו של אבדן אופיה היהודי של מדינת ישראל. במסגרת סרטון הסברה של התנועה הוצגו קטעים שלמים מתוך סרטון של תנועת הריבונות ובה מצהירים חברי כנסת ושרים על חזון הריבונות כתפיסתם המדינית-פוליטית וכשאיפה לעתיד מדינת ישראל.

 

הסרטון המדובר ביקש לעשות שימוש בקטעי וידאו אלו על מנת לנגח את תומכי הריבונות ולהציגם כמובילים את ישראל לעבר אסון. בא כוחה של תנועת הריבונות, עורך הדין גלעד קורינאלדי, מומחה בתחום הקניין הרוחני, קבע במכתב ששיגר לתנות המפקדים כי השימוש בקטעי הוידאו כולל בלוגו תנועת הריבונות המופיע בסרטונים אלו, אינו אלא שימוש המנוגד לחוק זכויות היוצרים, שימוש שנעשה ללא קבלת כל הרשאה לכך מתנועת הריבונות.

 

לזאת הוסיף עו"ד קורינאלדי וציין כי השימוש בקטעים המדוברים נעשה ל"שימוש פסול בתכלית באופן מסולף ומגמתי... תוך סילוף פוליטי פסול מכוון ומגמתי של תוכן ומטרת היצירה המקורית... ותוך פגיעה ממשית" בתנועת הריבונות ובעמדותיה "ותוך שימוש בקניינה הרוחני לצורך פוליטי הפוך ולמטרות ניגוח".

 

למכתבו זה צירף קורינאלדי דרישה להורדת הסרטון מעמוד הפייסבוק של תנועת המפקדים ולפצות כספית את תנועת הריבונות.

 

במענה למכתבו זה של עו"ד קורינאלדי כפר בא כוחה של תנועת המפקדים, עו"ד שי מרקוס, בטיעוניה של תנועת הריבונות, אך קבע כי תנועת המפקדים תסיר את הסרטון מעמוד הפייסבוק, וזאת "לפנים משורת הדין", ביום ראשון (7.4) הוסר הסרטון מעמוד הפייסבוק של התנועה.

Commanders for Israel's Security Remove Anti-Sovereignty Video

 

In the wake of charges of copyright infringement and of deleterious use of video clips of the Sovereignty movement, a video of the Commanders for Israel's Security has been removed.

 

Commanders for Israel's Security movement, which is conducting an aggressive public campaign against the sovereignty vision, removed from the Internet a video in which they used video material belonging to the Sovereignty movement. This was announced by the legal representative of Commanders for Israel's Security in response to the charges of the Sovereignty movement that use of the video was undertaken through violation of the copyright, and whose objective was to undermine the Sovereignty movement and to challenge its objectives.

 

The Commanders for Israel's Security movement distributed the video in question as part of a campaign that views the vision of Israeli sovereignty in Judea and Samaria as the beginning of the loss of the Jewish character of the State of Israel. In the framework of that movement's information video, excerpts from the Sovereignty movement's video were presented, in which Knesset members and government ministers declared that the sovereignty vision was their political philosophy and an aspiration for the future of the State of Israel.

 

The video in question sought to employ these clips in order to challenge the supporters of sovereignty and to portray them as leading Israel on the road to disaster. The legal representative of the Sovereignty movement, Gilad Corinaldi, esq.,  an expert in the area of intellectual property, established in a letter that he sent to the Commanders that the use of these video clips, including the logo of the Sovereignty movement, which appears in said clips, is nothing other than use contrary to copyright law, use that was undertaken without authorization from the Sovereignty movement.

 

Mr. Corinaldi, esq. added and noted that the use of the excerpts in question was undertaken "for completely improper use in a distorted and tendentious manner…through deliberate improper and bias distortion of the content and the objective of the original product…while at the same time causing real damage" to the Sovereignty movement and its positions "and while employing its intellectual property for contrary political purposes and for the purpose of confrontation."  

 

Corinaldi attached to this letter a demand to remove the video clip from the Facebook page of Commanders for Israel's Security and to financially compensate the Sovereignty movement.

In response to this letter of Mr. Corinaldi, esq., the legal representative of the Commanders movement, Shai Marcus, esq. denied the claims of the Sovereignty movement, but determined that the Commanders movement would remove the video from its Facebook page, but is doing so beyond the letter of the law. On Sunday, April 7, the video was removed from the movement's Facebook page.
