מה בדיוק הבעיה של ביידן עם אכיפת החוק בישראל?

הצו של ביידן נגד "מתנחלים אלימים קיצוניים" אינו משפטי אלא פוליטי. אבל לישראל יש קלף די חזק מולו אם רק תהיה אמיצה.
תבינו כמה מופרך ופוליטי הצו הנשיאותי שהוציא הנשיא ביידן כנגד "מתנחלים אלימים קיצוניים",
בשבוע שעבר.
הטענה העיקרית של האמריקנים היא שישראל אינה אוכפת את החוק במידה מספקת ביו"ש, מה שמאפשר, "התקפות של מתנחלים ישראלים נגד פלסטינים והתקפות פלסטיניות נגד ישראלים".
במה מואשמים אותם ארבעה ישראלים על ידי הממשל? 'הובלת מהומות, הצתת כלי רכב ומבנים, גרימת נזק לרכוש, תקיפת פלסטינים וישראלים באבנים ובאלות, חסימת כלי רכב וניסיון לשבור חלונות של כלי רכב, הובלת פעולות שיצרו אווירת פחד שריפת שדות והרס רכוש'.
כמובן שהאמריקנים נשענים על גרסתם החד צדדית של האנרכיסטים, בלי לאפשר לישראלים לספק את ההסברים שלהם – הפרה של עקרונות צדק בסיסיים.
אבל לצורך הדיון נניח שכל הטענות נכונות. בסופו של דבר מדובר באירועים של אלימות קלה. לא טרור. לא רצח. לא ירי. לא סחר בבני אדם. אלא חילופי מהלומות והצתות. לא יפה כמובן אבל בהחלט לא פשעים חמורים.
ישראל מצידה טוענת שהיא חוקרת, אוכפת ומענישה. כזכור המדינה גם מפעילה צווים דרקוניים של הרחקה מיו"ש ואפילו מעצר מנהלי, בהתאם לשיקול הדעת של גורמי הביטחון. זה מה שעושה ישראל במטרה לדכא אלימות בלתי נשלטת.
ומה קורה בארה"ב?
על פי נתונים של האף.בי.איי. מדי שנה יש בארה"ב, מעל 20,000 מעשי רצח בלתי מפוענחים. הבנתם? לא דחיפות, מכות או מריבות, אלא רצח.Homicides . מדובר במחצית ממקרי הרצח שהרשויות לא מצליחות לשים את ידן אפילו על חשוד, שלא לדבר על העמדה לדין.
יותר מזה, על פי ארגונים לא ממשלתיים, מעשי רצח של לבנים מפוענחים במספרים גבוהים בהרבה משל היספנים, ושל היספנים יותר משל שחורים. כלומר, יש סיבות טובות לטעון שהמספרים האלה גם מריחים מאפליה.
האם מישהו מעז לטעון שארה"ב היא מדינה שרמת אכיפת החוק בה אינה מספקת? שיש להטיל עליה עיצומים? לפקפק ביכולותיה? כך שעל מה אנחנו מדברים פה?
מעבר לכל זה, הבית הלבן טען שהצו מכוון גם נגד, "התקפות פלסטיניות נגד ישראלים". אם כך, מדוע לא הוטל צו דומה כנגד אף פלסטיני? מה על פי האמריקנים דין כל אותם פלסטינים שבאים להתעמת עם יושבי חוות הישראלים? ביידן ובלינקן יודעים שכל הפלסטינים נקיים מאשמה ורק היהודים אשמים?!
ישראל אינה חסרת אונים בעימות הזה. יש לה קלף חזק והוא העברות הכספים לרשות הפלסטינית על ידי בנקים ישראלים*. מעט אנשים מודעים לכך שהבנקים בישראל זוכים כבר עשרות שנים, למחילה דה פקטו של הרשויות בארה"ב על ביצוע העברות כספים המקושרות לטרור. מדובר כמובן בכספי המיסים לרשות הפלסטינית, שגם הרשות למאבק בהון שחור בארה"ב, וגם חוק טיילור פורס, אוסרים על האמריקנים עצמם לבצע.
הבנקים הישראלים הגדולים שכולנו מכירים, זוכים להעלמת עין אמריקנית כיוון שהרש"פ היא כמובן בבת עינו של הממשל. כלומר, ישראל יכולה לומר לאמריקנים באופן די פשוט – אם תמשיכו לגלגל עלינו אבנים מההר, אנחנו נעצור את העברות הכספים למחמדת לבכם, הרש"פ, בנימוק שהיא תומכת פיננסית בטרור. אתם יודעים שזה אסור וגם אנחנו יודעים. אז מספיק עם העמדות הפנים.
כמובן שנדרש פה קצת אומץ ישראלי אבל אין ברירה.
לכל זה יש להוסיף את הדברים החשובים של השגריר פרידמן, שמסביר כי הצו מכוון כלפי כל מי שמתנגד לרעיון שתי המדינות – כלומר רוב מוחלט של הישראלים. שלא לדבר על כך, שעצם השימוש בצו נשיאותי כדי לאכוף עמדה פוליטית הוא די מדהים.
בשורה התחתונה, בתוך האתגרים הרבים שמוצבים בפני ההנהגה בימי מלחמה אלה, אין ברירה אלא לצאת למערכה גם בנושא הזה. לא כדי להגן חלילה על הפרות חוק ואלימות – אלה ודאי פסולות – אלא כדי לשמר על מעמדה של מערכת אכיפת החוק הישראלית. בסופו של דבר, האמריקנים מכתימים אותה הרבה יותר מאשר את אותם ארבעה ישראלים.

Biden's order against "violent, radical settlers" is not a legal move, but a political one. Yet Israel has a fairly strong bargaining chip against it if only it has the courage to use it.
Understand just how unreasonable and political is the presidential order issued by President Biden against "violent radical settlers" last week.
The Americans' main claim is that Israel is not sufficiently enforcing the law in Judea and Samaria, which enables "attacks by Israeli settlers against Palestinians and Palestinian attacks against Israelis".
But what is the administration accusing those four Israelis of doing? "Leading riots, setting vehicles and buildings on fire, damaging property, attacking Palestinians and Israelis with rocks and clubs, blocking vehicles and attempting to break windshields, engaging in activities to create an atmosphere of fear, burning fields and destroying property."
Of course, the Americans rely on the one-sided version of the anarchists, without allowing the Israelis to present their own explanations – a violation of basic principles of justice.
But on top of that for the sake of argument, let's assume that everything they claim is correct. Ultimately, these are events of minor violence. Not terror. Not murder. Not shooting. Not human trafficking. There are fights and arson. It is not appropriate, of course, but also, decidedly not severe crime.
Israel, for its part, claims that it investigates, enforces the law and punishes wrongdoers. As we know, the state also brings into play draconian commands (against Jews) such as restraining orders, forbidding certain persons from entering Judea and Samaria and even administrative arrest, according to the discretion of security officers. This is what Israel does to suppress uncontrolled violence.
And what happens in the U.S.?
According to data from the FBI, each year in the U.S. there are more than 20,000 cases of unsolved murder. Understand? Not pushing, beating or fighting, but murder. Homicides. This means that the authorities don't manage even to identify a suspect in half the murder cases, let alone putting them on trial.
More than this, according to non-governmental organizations, murders of white people are solved much more often than of Hispanics, and of Hispanics more than of Blacks. That is, there are good reasons to claim that these numbers also smack of discrimination.
Does anyone dare to claim that the U.S. is a state that does not sufficiently enforce its laws? That it should be sanctioned? Or doubt its capability? So what are we talking about here?
Beyond all of this, the White House claims that the order is also directed against, "Palestinian attacks against Israelis". If so, why is there not a similar order imposed on even one Palestinian? What, according to the Americans, is the law for all the Palestinians who come to confront residents of Israeli farms? Biden and Blinken know that all the Palestinians are innocent and only Jews are guilty?!
Israel is not powerless in this conflict. It has a strong bargaining chip which is the transfer of monies to the Palestinian Authority via Israeli banks. Few people are aware of the fact that for the past thirty years, the banks in Israel have been granted de facto amnesty by the authorities in the U.S. for executing the transfer of funds tied to terror. This, of course, is taxes to the Palestinian Authority, which forbids the Americans themselves to carry out, both by the Bank Secrecy Act and the Tyler Force act in the U.S.
This activity by the large Israeli banks, which we all know, are overlooked by America because the PA is, of course, the apple of the administration's eye.
That is, Israel can simply say to the Americans – if you continue to roll rocks at us from the mountain, we will stop transferring money to your darling, the Palestinian Authority, on the grounds that it is a financial supporter of terror. You know that this is forbidden and we know it too. So no more pretending.
Of course, this will require Israeli courage but there is no choice.
And to all this, we must add the important words of Ambassador Friedman, who explains that in fact the order is targeted toward anyone who opposes the idea of two states -that is, the absolute majority of Israelis. Not to mention that the mere fact that the presidential order is used to impose a political position is pretty amazing.
Bottom line, among the many challenges facing the Israeli leadership during these days of war, there is no choice but to go to battle on this subject as well. Not, Heaven forbid, to defend the violations of law and violence – these things are, of course, not acceptable – but to protect the position of the Israeli law enforcement system. Ultimately, the Americans taint it much more than those four Israelis.
