המשטרה לנשים בירוק: הכינו מסלול חלופי לצעדת ליל תשעה באב
קצין משטרה המליץ לראשי 'נשים בירוק' להכין מסלול חלופי שאינו עובר במזרח ירושלים לצעדה המסורתית בליל תשעה באב. נשים בירוק: זו כניעה לטרור.
עו"ד אביעד הכהן הצטרף למאמצי נשים בירוק לשמור על מסלול הצעדה המסורתי.
מסלולה של צעדת ליל תשעה באב המסורתית מוטל בספק. כך הודיע גורם משטרתי לראשי תנועת 'נשים בירוק' המארגנת את ההצעדה זו השנה ה-23 ברציפות.
לקראת הצעדה קיבלו ראשי התנועה, יהודית קצובר ונדיה מטר, שיחת טלפון מקצין משטרה שטען כי מומלץ לשתיים להיערך להחלפת מסלול הצעדה כדי שזו לא תעבור כלל במזרח ירושלים. זאת בעוד עניינה של הצעדה הוא הקפת חומות ירושלים כביטוי לערגתו של העם היהודי לירושלים ולהר הבית דווקא בליל תשעה באב.
בתנועה רואים בהודעה זו של המשטרה כניעה ופרס לטרור. "מזה 23 שנים מתקיימת הצעדה באין מפריע, למרות התראות וחששות ולמרות שנים בהן חל מועד הצעדה בחודש הרמאדן. הצועדים מקיימים את הצעדה ללא כל התגרות או חיכוך עם האוכלוסייה הערבית ואין כל סיבה להגביל את הצעדה כעת. אם חלילה ישונה תוואי הצעדה יהיה זה בגדר פרס לפורעים ולרוצחים. לא ייתכן שבעוון המהומות של פורעים ורוצחים יענישו את קרבן מתקפות הטרור וימנעו ממנו לקיים מסורת בת מאות שנים. זו בדיוק השעה לנהוג כבכל שנה ושנה ולהוכיח שהטרור לא ינצח את עם הנצח", אומרות קצובר ומטר.
למערכה על קיומה של הצעדה התגייס עו"ד הפרופ' אביעד הכהן, מי שליווה את המאבק המשפטי לקיומה של הצעדה כבר בשנתה הראשונה. היה זה כאשר המשטרה ביקשה שלא לאשר את מסלול הצעדה. פרופ' הכהן עתר לבג"צ שהורה למשטרה לאשר את הצעדה כמתוכנן. כעת, 23 שנים אחרי, שיגר הכהן מכתב למפקד המחוז, ניצב יורם הלוי, ובו הוא מבהיר את האבסורד שברעיון הגבלת הצעדה המסורתית.
"כידוע לכם היטב, תהלוכה זו מתקיימת מזה 23 שנים בליל תשעה באב, תמידין כסדרן ומוספין כהלכתן. יש בה המשך למסורת בת מאות רבות של שנים, דתית ולאומית, של הקפת חומות העיר העתיקה והר הבית בתשעה באב, המתועדת במקורות הלכתיים והיסטוריים שונים. בכל אותן שנים רבות, עברה הצעדה בסדר מופתי, תוך שהצועדות והצועדים ממשים את זכותם לחופש ביטוי והמשטרה עושה את תפקידה בהגנה עליהם ובשמירה על הסדר הציבורי", מתאר עו"ד הכהן במכתבו.
הכהן ציין כי למרות שחששות גורמי ביטחון בשנים שעברו לא התאמתו הרי ש"קיבלו מרשותיי "שיחת בירור" בטלפון משוטר שהמליץ להן כי למרות שהצעדה מתקיימת מזה עשרות שנים במסלול קבוע, לנוכח ה"מתיחוּת" בירושלים, על מרשותיי להיערך כבר מעכשיו לצעידה במסלול ש"לא יעבור כלל במזרח העיר". השוטר לא פירט כיצד הוא יודע כבר כעת מה תהא עוצמתה המדויקת של אותה "מתיחות" הצפויה להתרחש רק בעוד כשבועיים ימים, בשעות הלילה של תשעה באב (והמתיחוּת, כידוע, למרבה הצער, מאפיינת את ירושלים בהרבה מימות השנה במשך שנים ארוכות), ומה פשר ה"אזהרה הגורפת והמוקדמת" – שלא לומר הודעה על פגיעה קשה בחופש הביטוי, ההפגנה האסיפה והתהלוכה - שלפיה לא תוכל הצעדה לעבור כלל במזרח העיר, וזאת כשבועיים לפני מועדה המתוכנן וכשאיש אינו יודע עדיין מה יהיה המצב באותם ימים".
לדבריו "ל"אזהרה" מעין זו אין כל מקום והיא סותרת מושכלות יסוד של משטר דמוקרטי ושלטון חוק ראוי לשמו". במכתבו מבקש עו"ד הפרופ' הכהן ממפקד המחוז "להבהיר באופן חד משמעי, שאינו משתמע לשתי פנים, שהמשטרה לא תפגע המשטרה בזכות מרשותיי וחבריהן לממש את חופש הביטוי והתהלוכה, וכי הם יוכלו לצעוד גם השנה במסלול הצעדה המסורתי".
כאן המקום לציין כי במלאת חמישים שנה לאיחוד העיר תיוחד הצעדה המתוכננת לשיתוף פעולה מאוחד עם יהודי התפוצות. לקראת הצעדה פנתה תנועת 'נשים בירוק' לקהילות יהודיות בעולם והציבה בפניהן את האפשרות להשתתף בתרומה לצעדה שתשודר בשידור חי בעמוד הפייסבוק של התנועה. תרומה זו תשמש למימון הצעדה ושמותיהם של התורמים ותמונתם יונפו בידי המשתתפים בצעדה, ולבקשתם תוקרא הודעה מטעמם במהלך האירוע.

Police to Women in Green: Prepare an alternative route for your Tisah BeAv Walk
A police officer recommended to the heads of Women in Green to prepare an alternative route that does not pass through East Jerusalem for the traditional march on the night of Tisha B'Av. Women in Green: This is capitulation to terror. Attorney Aviad Hacohen has joined Women in Green's efforts to safeguard the tradtional route of the Walk.
The route of the traditional Tisha B'Av walk is being questioned, a police source told the heads of the Women in Green movement, which is organizing the march for the 23rd consecutive year.
The leaders of the movement, Yehudit Katsover and Nadia Matar, received a telephone call from a police officer who told the two to be prepared to change the route of the walk so that it would not pass through East Jerusalem. This would take away the entire purpose of the walk which is to surround the walls of Jerusalem as an expression of the longing of the Jewish people for Jerusalem and the Temple Mount on the night of Tisha B'Av.
Women in Green views this announcement by the police as a surrender and a reward for terrorism. "For 23 years, the walk has been taking place unhindered, despite warnings and fears, and despite years of walking in the month of Ramadan, the walkers walk without any provocation or friction with the Arab population, and there is no reason to restrict the walk now. If, heaven forbid, the route of the walk is changed, it will be a reward for the rioters and murderers. ... It is inconceivable that the riots of rioters and murderers will lead to the punishment of the victims of terrorist attacks and prevent them from practicing a tradition of hundreds of years ... It is precisely the time to act like every year and to prove that terrorism will not defeat the eternal people" say Yehudit Katsover and Nadia Matar.
Attorney Aviad Hacohen has joined the efforts of Women in Green to keep the traditional route of the Walk. Attorney Aviad Hacohen accompanied the legal struggle for the walk in its first year 23 years ago, when the police asked not to approve the route of the walk, and Prof. HaCohen then petitioned the High Court of Justice and won. The Supreme Court at the time ordered the police to approve the walk as planned . Now, 23 years later, Hacohen sent a letter to the district commander, Major General Yoram Halevy, in which he clarifies the absurdity of the idea of restricting the traditional walk.

Greetings and Blessings,
Subject: the Annual Walk of "Women for Israel's Tomorrow" – Tisha b'Av Eve
1. I hereby address you concerning this matter on behalf of my clients, Ms. Nadia Matar, Ms. Yehudit Katsover and the movement, "Women for Israel's Tomorrow" – following the request that they served, to hold the organization's traditional walk.
2. As you well know, this walk has been held for the past 23 years on the eve of the 9th of Av, as planned and as scheduled. This is a continuation of a religious, national tradition hundreds of years old, encircling the walls of the Old City and the Temple Mount on the 9th of Av, which is documented in various halakhic and historical sources.
3. Throughout the years, the procession has proceeded in a very orderly fashion, as the participants realized their right to freedom of expression and the police fulfilling its role in defending them and keeping the public order , and my clients thank you for this.
4. As in every year, my clients have served their request to the competent authorities in advance.
5. Included in the request is the detailed route of the walk, which does not differ from the route that has been approved in previous years.
6. Moreover: despite the fact that in previous years – because of variations in the Muslim calendar – the 9th of Av has occurred during the month of Ramadan, which created concern among security authorities – a concern that has not been substantiated – of any disturbance of public order, and the walk has proceeded peacefully.
7. Despite this, my clients have received by telephone a "discussion of clarification" from a police officer who recommended that despite the walk having been held for the past decades on a fixed route, in light of increasing tensions in Jerusalem, my clients must now plan for the walk to take a route that "will not pass at all through the eastern part of the city".
8. The police officer did not specify how he knows at this time what the exact degree of the expected "tensions" will be, in another two weeks, on the night of the 9th of Av eve (and the tension, as we know, unfortunately, has been characteristic of Jerusalem on many days of the year, for many years), or the meaning of the "early, sweeping warning" – not to mention the severe blow to the freedom of expression, demonstration assembly and procession – meaning that the walk will not be allowed to pass at all through the eastern part of the city, and this, two weeks before, when no one yet knows what the situation will be at that time.
9. With all due respect, this type of "warning" is out of place and contradicts all basic principles of democratic governance and rule of law worthy of its name.
10. This announcement is, in a way, asserting not only that there will be disturbances, to some degree; a prize will be given to those who disturb the public order. And instead of enforcing the law on them, the ones who will be "punished" are those who only request to realize their right to freedom of expression and hold the traditional walk that has existed for many hundreds of years.
11. Needless to say – and as we have noted in our appeal to you in previous years –the route of the walk around the walls of the city and their surroundings is not incidental.
12. Beyond continuing the tradition of many years, this walk is an expression of the right of the Jewish People in Jerusalem and the sovereignty of the State of Israel in it. This walk is also an expression of Jerusalem being – in each of its sections, the east and the west alike – one of the prime national assets.
13. For all of these reasons, and to alleviate my clients' concerns, we therefore request for you to clarify unambiguously, unequivocally, that the police will not harm the right of my clients and their associates to realize their freedom of expression and procession, and that they will be able to walk this year as well, on the traditional route of the walk, which is specified in the request that they have served to you.
14. In light of the proximity of the planned event, we request that you respond to us on this matter as soon as possible, so that my clients will be able to plan their next steps, literally.
15. Needless to say, my clients greatly appreciate your contribution to the peace of Jerusalem and in keeping public law and order within the city, which goal and objective we all share.

Here, it is worth noting that on the occasion of the fiftieth anniversary of the unification of the city, the planned walk will be dedicated to joint cooperation with Diaspora Jews. Women in Green has called upon Jews around the world and offered them the opportunity to participate in a live broadcast on the movement's Facebook page. With a contribution of at least $100 that will be used to finance the walk, the names of the donors will be held by the participants in the walk, and if they so wish a notice will be read on their behalf during the event.
Women in Green will update as to further developments.
This year's public figures that will participate and talk at the annual Walk are: Minister Zeev Elkin, minister of Jerusalem Affairs and Environmental protection; Dep. Minister of Defense Mk Rabbi Eli Ben-Dahan; MK Yehuda Glick; Menahem Aby Levi who participated in the liberation of Jerusalem; Yishai Fleisher international spokesman for the Hebron community; Jacques Kupfer chair Israel is Forever and Arieh Klein, historian.
